NOTICE OF CONSULTATION: Section 106 of the National Historic Preservation Act of 1966 as Amended (2006)

NATIONAL HISTORIC PRESERVATION ACT SECTION 106 PROGRAMMATIC AGREEMENT FOR MINOR HAWAIʻI HISTORIC BRIDGE PROJECTS STATEWIDE

Notice is hereby given that the Federal Highway Administration (FHWA) and State of Hawaiʻi Department of Transportation, Highways Division (HDOT) propose to develop a statewide Programmatic Agreement for Minor Hawaiʻi Historic Bridge Projects. This proposed project is a federal funded HDOT project. It will consider projects where the effects on historic properties are similar and repetitive (800.14 (b) (1) (i), as defined by Section 106 of the National Historic Preservation Act (NHPA) of 1966, as amended (2006).

The State of Hawaiʻi has approximately 400 highway bridges that have been deemed eligible or potentially eligible for the National Register of Historic Places.The Minor Hawaiʻi Historic Bridge Projects PA is intended to streamline implementation, review, and reporting for individual bridge projects that will not affect, are not likely to affect, or have minor effects on historic properties, consistent with the requirements of Section 106 of the NHPA, and the implementing regulations in 36 C.F.R. Part 800.The PA will not address major bridge rehabilitation or replacement projects.

BURIAL NOTICE: North Kona District, Island of Hawaiʻi

All persons having information concerning unmarked burials on TMK: (3) 7-4-009:072 in Kealakehe Ahupuaʻa, North Kona District, Island of Hawaiʻi are requested to contact Matthew Clark, ASM Affiliates, (808) 969-6066, 507A E. Lanikaula St., Hilo, HI 96720, and/or Kea Calpito, DLNR-SHPD Burial Sites Program (808) 933-7653, 40 Poʻokela St., Hilo, HI 96720. The subject property is part of a land grant awarded to Beniamina in 1896.

Appropriate treatment of the remains will occur in accordance with HRS, Chapter 6E, respective to this burial site. The landowner intends to preserve the burial in place, following the preparation of a Burial Treatment Plan in consultation with any identified descendants and with the approval of the Hawaiʻi Island Burial Council. All interested parties should respond within thirty (30) days of this notice and provide information to DLNR-SHPD adequately demonstrating lineal descent from these specific Native Hawaiian remains, or cultural descent from ancestors once residing or buried in the same ahupuaʻa or moku.
